The company Lyroweb, SL (hereinafter called RentalScout) will procure rental
vehicles to the client (lessee) from the contracting company (lessor).
The rental contract will be executed between the lessee and the lessor
on site, in the national language. The lessee will accept with no
restrictions the terms of the rental stated by the lessor. RentalScout
is only the mediator and not the representative of the relevant lessor.
2.
Booking and confirmation
The booking of the
rental vehicle will be carried out by means of our web page, by e-mail,
telephone or fax. There are two types of bookings:
FREE-SALE:
In the case of a
“FREE-SALE” vehicle booking (available vehicle categories, booked at
least 48 hours before collection) the confirmation will be
automatically sent through our web page to the e-mail address stated by
the lessee and, subsequently, the lessor will send a confirmation to
RentalScout. Nevertheless, in the case the lessor does not confirm back
regardless the reason, RentalScout reserves the right to cancel the
mentioned booking.
ON-REQUEST:
In the case of
vehicles requiring some kind of additional confirmation from the lessor
(“ON REQUEST”), the sending of the confirmation of the booking could
delay up to 24 hours or more (we kindly ask you to pay attention to
weekends and bank holidays). As soon as we have the confirmation from
the lessor, we will send the receipt or voucher by e-mail or fax.
When you
collect the vehicle, you must show the booking confirmation (voucher)
to the lessor (you may request a copy of your voucher in the costumer’s
area on our web page). In the voucher you will find all the relevant
details of the booking, services included, and what are the services
you have to pay for on site.
We kindly ask
you to bear in mind that in order to assure a correct delivery of the
vehicle in the airport, the lessor needs the flight number and the
exact time of arrival at least 48 hours in advance.
3.
Price calculation
RentalScout reserves
the right to modify without prior notices the stated fees and services
shown on our website. The bookings confirmed before the modification of
the prices will not be affected by the price increase. All the prices
include VAT. When changing from high to low season, for instance, the
price of the first day of the booking will be relevant for the entire
rental period. The rental price is calculated in a 24 hours
rhythm from the moment the vehicle is collected. The vehicle shall be
returned on the day of return maximum at the same time it was
collected. In the case the 24 hours rhythm is exceeded, different fees
depending on the lessor and the country will be due. RentalScout has no
influence on this matter.
4.
Deposit and payment
The payment of the
deposit will be different depending on the lessor and the country. In
most cases, it will consist of the value of the fuel to fill the first
tank. We kindly ask you to bear in mind that on some occasions the
lessor will request for the payment of the contract and for the deposit
a credit card issued in the name of the main driver.
5.
Insurance of the rental vehicle
Depending on the
country and the lessor, the insurance of the vehicle will be different.
In the booking confirmation you will find the exact insurance-details
of the vehicle you booked.
Generally, the price of the rental includes the following insurances:
Compulsory
liability insurance (Third party insurance)
Fully
comprehensive insurance (CDW, crash term - with or without excess)
Theft
protection (TP)
The damages not
covered by the insurance are:
Glass and
mirrors broken
Damages of
the underside of the vehicles (due to negligent use)
Damages of
tyres
Damages of
child seats or to different accessories
Damages to
the interior of the vehicle
Loss or
rupture of the keys
Use of
wrong fuel
6.
Additional insurances and fees
Depending on the
lessor, you may sign up for additional insurances (for instance,
insurance for tyres, for passengers, etc.). Also, there is the
possibility of further fees that should be paid to the lessor on site
(such as airport fees, delivery of vehicle in airport in hours out of
the trading hours, delivery at hotel, second driver, additional fees in
the case of a diesel car, etc.). The specific rental terms from the
relevant lessor will be stated in the booking confirmation. We are at

7.
Vehicle categories
Bookings can only be
confirmed in accordance with the vehicle category, but not with a
specific model or brand, nor with the kind of fuel. The mentioned
vehicle models are an example of the size and features of the category.
In the case the booked category is not available: the lessor reserves
the right to provide a vehicle of a higher category.
8.
Cancellation of a booking
The cancellation of a
booking will bear no cost for the lessee, and he shall inform us (by
e-mail or telephone) at least 48 hours before the rental. You may also
cancel the booking by means of the customer’s area on our web page.
9.
Reception of vehicle and documents needed
During the booking
procedure, you will be informed about the lessor address and other
contact information. You may also find this information in the
confirmation of the booking. The minimum age for the driver, in most
countries, ranges between 21 and 25 years. The fuel expenses are not
included in the price and shall be paid at the beginning on site to the
lessor. We kindly ask you to previously find out about the kind of fuel
the vehicles requires to avoid filling the tank up with the wrong kind
of fuel. At the moment you collect the vehicle, the lessor shall be
shown the following documents, which shall be issued in the name of the
main driver:
Confirmation
of the booking (voucher)
Valid
driving license type III (B)
Passport /
valid id. document
Credit card
In the case the lessee has not the mentioned documents, he is under the
influence of drugs or alcohol, his behaviour is not adequate or
acceptable or has not the minimum age, the lessor reserves the right to
refuse the delivery of the vehicle. RentalScout accepts no liability
regarding these circumstances.
In order to ensure the claims, the lessee will have to immediately
inform us by telephone during the vehicle delivery about the
discrepancies regarding the promised services. Thus, we will be able to
immediately contact the lessor.
10.
Extension of rental contract
The extension of the
rental contract can be requested until the last rental day. In the case
the vehicle is not available; the lessor reserves the right to refuse
the extension of the contract or to change it for a different vehicle.
11.
Accessories
Depending on the
lessor, different accessories and extra features may be booked (for
instance, child seat, luggage rack, GPS, winter wheels, chains for
snow, etc.).
In the case of some of those accessories are required, a confirmation
by the lessor will be necessary. The fees for those extras will be
stated in your voucher. We will be glad to inform you about the

12.
Return of the vehicle in a different location
Depending on the
agency and on each lessor, you may return the rental vehicle in a
different office to the one you collected it from. In the confirmation
you will find the fees arising from this circumstance. We will be glad

13.
Obligation of informing about car accidents
Unless otherwise
stated in the lessor’s terms, car accidents shall be notified to the
lessor within the 24 hours following the accident; you must provide the
police report. Failure to comply with these terms may imply the loss of
the fully comprehensive insurance or the theft insurance. In the case
the vehicle is stolen, you shall immediately report it to the closest
police station and hand over the keys to the lessor.
14.
Liability
RentalScout is only
liable in the case of intent or gross negligence. Any liability is
limited to the price of the relevant booking. The liability is excluded
for consequential damages. Any damage or loss due to incidents or
occurrences for which we are not responsible (for example: lack of due
care, mistakes, omissions, features and services of the lessor) or
which are force major, will not be claimable. The only responsible for
the conditions of the vehicle and its technical features is the lessor.
The relevant jurisdiction to deal with the discrepancies is Denia
(Alicante, Spain).
